Please take a moment to read these terms before registering with the Trace19 service provided by Alliants Limited. These terms are an agreement between you and Alliants Limited and it is important that you understand this agreement. Registering for and/or using the Service constitutes acceptance of these terms.
1. Overview
Welcome to the Trace19 service provided by Alliants Limited ("Alliants").
Use of and access to the Alliants Trace19 service, including any rebranded or white label version of the Alliants Trace19 service, (the "Service") are subject to these terms and conditions of use (the "Terms")
Alliants (“We” or “Us” or “the Company”) reserves the right to change these Terms from time to time. Any updates to these Terms shall be posted on www.alliants.com. You (the “User”) acknowledge your responsibility to review these Terms from time to time and to be aware of any such changes. By continuing to use the Service after we post any such changes, you accept these Terms, as modified.
The Service is intended to support owners and managers of small businesses in the hospitality and leisure industry in their obligations to meet the guidelines and standards as laid out from time to time by the UK Government with respect to collecting the “track and trace” data of their customers.

You are responsible for obtaining and maintaining all computer hardware, software, and communications equipment needed to access the Service, and for paying all access charges e.g., a personal computer or laptop, ISP, etc.
Alliants is not responsible for the final delivery of any communication initiated through the Service as this is out of our control and is the responsibility of downstream communications carriers.
3. Usage Policy
You accept that the Service is provided solely for the purposes of supporting the NHS Track & Trace and NHS Test & Trace programs, and you agree that your use of the Service will be strictly limited accordingly - for example you must only access the Trace19 web-based interface (the Service) at the specific request of an employee of the NHS and then only in relation to the NHS Track & Trace and the NHS Test & Trace initiatives. Also, that this agreement expressly excludes accessing the Service and/or sharing the information therein for any purpose other than that described in this agreement.
You accept that Alliants may monitor and/or record any and all logins, access to, and activity within, the Service and that Alliants reserves the right to take any action which we believe, at our sole discretion, to be necessary. Should there be any activity which we believe to be suspicious or outside the terms or spirit of this agreement, we reserve the right to take any steps we deem necessary, including but not limited to, cancelling the Service without any notice and/or reporting any suspicious activity to the NHS or any other authority.
4. Username / Password
As part of the registration process you will need a username and/or password. You agree to notify Alliants of any and all known or suspected unauthorised use of your user account, or any known or suspected breach of security, including loss, theft, or unauthorised disclosure of your username or password. You shall be responsible for maintaining the confidentiality of your password. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your user account, at Alliants' sole discretion, and you may be reported to appropriate law-enforcement and government agencies.
5. Intellectual Property
We may have copyrights, trademarks, patents, trade secrets, or other intellectual property rights covering subject matter in the Services, including the web pages that are part of the Service. Except as expressly provided in these Terms, the availability of the Service does not give you any license to these patents, trademarks, copyrights, or other intellectual property. All copyrights, trademarks, patents, trade secrets and other intellectual proprietary rights contained in the Service are the sole property of Alliants or its licensors, each of whom reserves all rights with regard to such materials. All other trademarks or trade names are the property of their respective owners, and such material may not be copied, downloaded, redistributed, modified or otherwise exploited, in whole or in part, without the permission of the owner.
6. Data Protection & Privacy
Alliants is based within the United Kingdom, and as such is registered with the Information Commissioner’s Office (ICO) as a Data Processor under the UK Data Protection Act of 1998 (the “Act”). We have also aligned our Privacy Policy with the EU General Data Protection Regulation (“GDPR”) which came into effect on 25th May 2018, under the supervision of the ICO within the UK.
You and Alliants will also comply with requirements of the Act and GDPR, in the processing of any personal data, including the mobile telephone numbers which may be collected, as a consequence of making the Service available to you (such personal data referred herein collectively as “End-User Data”), under or in connection with these Terms.
In respect of the End-User Data you appoint Alliants as a data processor in accordance with the Act and GDPR and Alliants agrees to act only on and in accordance with your reasonable instructions in relation to the End-User Data and at all times to comply with our obligations.
7. No Warranty; Limitation of Liability
Alliants reserves the right to modify, suspend, or discontinue the offering of any of the Service at any time for any reason without prior notice.
Alliants makes no warranty or guarantee that (i) the Service will be available at any particular time; or (ii) you will be able to access the Service at any particular time or from any particular location. Alliants will not be liable for any act or omission of any other company or companies furnishing a portion of the Services (including, without limitation communications carriers or ISPs)
8. User Warranties; Indemnification
You warrant and represent to Alliants that you are and shall at all times remain in full compliance with all applicable laws, rules and regulations with regard to your use of the Alliants Service, including without limitation the Privacy and Electronic Communications Regulations, and all other laws and regulations concerning privacy and data protection.
You agree to indemnify and hold harmless Alliants and its affiliates and each of their respective officers, directors, shareholders, employees, agents, contractors, representatives, content providers and service providers, from and against any and all losses, claims, obligations, liabilities, damages, settlements, costs and expenses.
9. Termination, Cancellation and/or Suspension by Alliants
We reserve the right to suspend the Service at any stage for any reason we may deem necessary.
Upon termination, for any reason, you agree to immediately cease using the Service and Alliants shall have no obligation to you after any termination or cancellation of these Terms.
The provisions regarding ownership, warranties, and indemnifications will survive any suspension, termination, or cancellation of your use of the Service.
10. Termination by the User
You are free to terminate or cancel your use of the Service at any time, and for any reason. Upon termination or cancellation, you must cease to use the Service immediately.
11. Links to other Websites
The Alliants Service may contain links to third party websites. These links are provided solely as a convenience to you and not as an endorsement by Alliants of the contents on such third-party websites. Alliants is not responsible for the content of linked third-party websites and does not make any representations regarding the content or accuracy of materials on such third-party websites.
12. Security Rules
You are prohibited from violating or attempting to violate the security of the Alliants Service and from using the Alliants Service to violate the security of other websites by any method
13. Force Majeure
Alliants shall not be liable for any failure or delay in performing its obligations hereunder, which such failure or delay is caused by fire, flood, earthquake, pandemic or epidemic, elements of nature or acts of God, acts of war, insurrection, terrorism, strike, failure or downtime of any telecommunications line and/or unavailability of any telecommunications or Internet facilities, power failure, governmental restrictions, any court order, compliance with any law, regulation, or order of any governmental authority, or any other cause beyond the reasonable control of Alliants.
14. Choice of Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English courts. These Terms are only those stated herein, which shall constitute the complete agreement between the parties.
15. Miscellaneous
The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
All notices required hereunder shall be in writing and will be deemed to have been duly given when received.
